RETURNS, REFUNDS, AND CANCELLATION POLICY

This Returns and Refunds Policy (hereinafter referred to as the "Policy") governs all transactions, purchases, and interactions related to digital products sold through the online storefront known as Kreatyx (hereinafter referred to as the "Store" or "Platform").
For the avoidance of doubt, and to ensure complete transparency regarding corporate identity, the user acts with full knowledge that Kreatyx is not a separate legal entity but is a subsidiary storefront and proprietary trading name wholly owned, operated, and managed by Novestra LLC (hereinafter referred to as the "Company," "Parent Company," "we," "us," or "our").
1.2. Reservation of Rights
All intellectual property rights, operational control, financial entitlements, and legal liabilities associated with Kreatyx reside exclusively with Novestra LLC. All content, digital goods, trademarks, logos, and proprietary methodologies presented on the Kreatyx store are the intellectual property of Novestra LLC, and ALL RIGHTS ARE RESERVED BY NOVESTRA LLC.
By purchasing from Kreatyx, you (the "Customer," "User," or "Buyer") acknowledge that your contractual agreement is formed directly with Novestra LLC, doing business as Kreatyx.
1.3. Commitment to Satisfaction
While Novestra LLC is steadfast in its commitment to providing high-quality digital resources, software, and content, the intangible nature of digital goods requires a specialized policy distinct from physical retail. This Policy is designed to be comprehensive, ensuring you fully understand your rights and obligations before finalizing any purchase.
2. DEFINITIONS AND INTERPRETATION
To ensure there is no ambiguity in the enforcement of this Policy, the following terms are defined as follows:
- Digital Product: Refers to any intangible good, file, data, software, code, ebook, template, graphic, audio file, or course material that is delivered via electronic download, email, or access to a private membership area. Unlike physical goods, Digital Products cannot be "returned" in the traditional sense as they remain in the user's possession indefinitely once downloaded.
- Immediate Access: The state in which a link, file, or access code is made available to the Customer immediately or shortly after the payment is successfully processed.
- Defect: A material technical fault that prevents the Digital Product from functioning as described. This includes corrupted files, missing pages in a PDF, or software bugs that render the product unusable. This does not include personal dissatisfaction with the aesthetic style or a lack of technical skills to use the product.
- Subsidiary Store: Refers to Kreatyx's status as a brand extension and retail outlet under the legal umbrella of Novestra LLC.
- Consumer: An individual acting for purposes that are wholly or mainly outside that individual’s trade, business, craft, or profession.
- Force Majeure: Unforeseeable circumstances that prevent someone from fulfilling a contract, including but not limited to server outages, global internet disruptions, or payment gateway failures.
3. GENERAL POLICY: DIGITAL NATURE OF GOODS
3.1. The "All Sales Final" Standard
Due to the inherent nature of Digital Products, Novestra LLC adopts a strict "All Sales Are Final" standard for Kreatyx. Once a transaction is completed and the Digital Product has been made available to the Customer (whether via a download link, email attachment, or account access), the product is considered "consumed."
Unlike physical items, digital files cannot be un-learned, un-seen, or effectively returned. Consequently, Novestra LLC does not offer refunds based on "change of mind," "buyer's remorse," or "accidental purchase" once the file has been accessed or downloaded.
3.2. Acknowledgment of Waiver
By clicking "Buy Now," "Purchase," "Checkout," or any similar affirmation button on the Kreatyx interface, you expressly acknowledge and agree that:
- You are purchasing a digital, non-tangible good.
- You waive your right to a cooling-off period (where applicable by law) once the download or access has commenced.
- You have read the product description carefully and ensured compatibility with your device or software.
4. CIRCUMSTANCES ELIGIBLE FOR REFUND
Notwithstanding the General Policy outlined in Section 3, Novestra LLC recognizes that errors can occur. We are committed to fairness and will grant refunds under the following specific, verifiable circumstances:
4.1. Non-Delivery of Product
If you have successfully completed payment, but the delivery system failed to provide you with the product link or access credentials within twenty-four (24) hours, and our support team is unable to rectify the issue manually within a reasonable timeframe (defined as 48 hours from your initial complaint), you are eligible for a full refund.
4.2. Major Technical Defects
A refund may be issued if the Digital Product proves to be defective. A "Major Technical Defect" is defined as:
- A file that is corrupted and cannot be opened on any standard device.
- Software or templates that contain code errors preventing their primary function.
- Video or audio content that plays with significant distortion or is missing segments.
Condition for Refund: You must first contact Support@kreatyx.com and allow our technical team to attempt to troubleshoot the issue. If we cannot fix the file or provide a working replacement within three (3) business days, a full refund will be issued.
4.3. Misrepresentation
If the Digital Product you receive is fundamentally different from the product description and preview images on the Kreatyx store (e.g., you purchased a "Financial Excel Template" but the file download was a "Graphic Design Icon Pack"), you are entitled to an immediate refund or exchange, at your preference.
4.4. Duplicate Purchase
If you accidentally purchase the exact same Digital Product twice under the same email address within a 48-hour period, we will refund one of the transactions.
5. CIRCUMSTANCES NOT ELIGIBLE FOR REFUND
For the sake of clarity, and to protect Novestra LLC from fraudulent claims, refunds will NOT be granted under the following scenarios:
5.1. Incompatibility Issues
It is the Customer's responsibility to review the "System Requirements" or "Compatibility" section of the product page. We will not refund purchases where the Customer's device, software version, or operating system is incompatible with the Digital Product (e.g., buying a .pages Apple file when you only have a Windows PC, or buying a Photoshop template when you do not own Adobe Photoshop).
5.2. Lack of Expertise
Novestra LLC provides the tools/assets, but we do not provide educational training on how to use general software (e.g., Excel, Photoshop, WordPress) unless explicitly stated in the product description. We cannot offer refunds because the Customer does not know how to use the software required to edit or view the product.
5.3. Change of Mind
Statements such as "I don't need this anymore," "I found a better version elsewhere," or "I decided not to use it" are not valid grounds for a refund for digital goods that have already been accessed.
5.4. Failure to Download
If a product is available for download for a limited time (as stated in the purchase terms) and the Customer fails to download the product within that window, a refund will not be granted. However, Support may, at its discretion, regenerate the download link.
6. REGIONAL CONSUMER LAWS
Novestra LLC respects the consumer laws of the jurisdictions in which we operate. However, the application of these laws varies significantly for digital content.
6.1. European Union & UK Residents (Right of Withdrawal)
Under the EU Consumer Rights Directive and UK Consumer Contracts Regulations, consumers typically have a 14-day "Right of Withdrawal" for distance contracts. However, there is a specific exception for digital content.
By purchasing from Kreatyx, you expressly consent to the immediate performance of the contract (i.e., the immediate provision of the download link). You acknowledge that by granting this consent and accessing the digital content, you lose your right of withdrawal once the download or streaming process has begun.
6.2. United States Consumers
In the United States, there is no federal "cooling-off" rule for digital sales. Refund policies are generally governed by the terms set by the merchant. Therefore, this Policy serves as the binding agreement governing your purchase rights.
7. REFUND REQUEST PROCEDURE
To ensure your request is handled efficiently by the Novestra LLC support team, please follow this strictly defined procedure. Failure to follow these steps may result in a delay or denial of your request.
7.1. Submission Channel
All requests must be submitted in writing via email to: Support@kreatyx.com
Please use the subject line: "Refund Request - Order #[Your Order Number]"
7.2. Required Information
Your email must include the following details:
- Full Name: The name used during the purchase.
- Order Number: The unique transaction ID found in your receipt email.
- Date of Purchase: When the transaction occurred.
- Name of Product: The specific digital item you are disputing.
- Detailed Reason: A comprehensive explanation of why you are requesting a refund.
- Evidence (If applicable): If claiming a defect, you MUST attach screenshots or screen recordings demonstrating the error or corruption. Vague claims such as "it doesn't work" will not be accepted without visual proof.
7.3. Processing Timeline
- Receipt: We will acknowledge receipt of your request within 24–48 hours.
- Review: Our team will review the evidence, check server logs to verify download status, and assess the validity of the claim.
- Decision: A final decision will be communicated within 5–7 business days.
- Payout: If approved, the refund will be processed back to the original method of payment (Credit Card, PayPal, etc.). Please allow up to 10 business days for your bank to reflect the credit on your statement.
8. CHARGEBACKS AND DISPUTE RESOLUTION
8.1. Friendly Fraud Policy
Novestra LLC takes "friendly fraud" (the act of purchasing a product, using it, and then filing a chargeback with the bank claiming the transaction was unauthorized) very seriously. This is considered theft of intellectual property.
8.2. Consequence of Chargebacks
If a Customer initiates a chargeback or payment dispute without first contacting Support@kreatyx.com to resolve the issue amicably:
- Immediate Ban: The Customer will be permanently banned from Kreatyx and all future Novestra LLC properties.
- Revocation of License: All licenses to use the purchased Digital Products will be immediately revoked. Continued use of the products after a chargeback is a violation of copyright law.
- Legal Action: Novestra LLC reserves the right to report the incident to relevant credit bureaus and fraud prevention databases. We will submit full evidence to the payment processor, including server logs showing the IP address, time of download, and proof of product delivery, to contest the chargeback.
9. UPDATES AND MODIFICATIONS TO POLICY
9.1. Right to Modify
Novestra LLC reserves the right to amend, modify, or update this Returns and Refunds Policy at any time without prior notice. The decision to update the policy may be driven by changes in market conditions, legal requirements, or operational needs.
9.2. Notification
Significant changes will be indicated by changing the "Last Updated" date at the top of this page. It is the responsibility of the Customer to review this Policy periodically. Your continued use of the Kreatyx store following the posting of changes constitutes your acceptance of those changes.
